1. Introduction

These Terms & Conditions apply to all orders placed by you (the “Customer”) on the website www.losaeyewear.comau ("Losa Eyewear", “we”, “us”, “our”).
By placing an order, you agree to be bound by these Terms & Conditions. These cannot be amended by you unless agreed in writing by us.

We reserve the right to change or alter these Terms & Conditions or the website at any time at our sole discretion.

2. Orders & Payment

  • When you place an order for a product, you are making an offer to purchase that product at the price displayed (inclusive of GST, where applicable).
  • We will supply new products. Payment must be made in advance of delivery.
  • We reserve the right to accept or decline your order for any reason before delivery.
  • Receipt of payment or an order confirmation email does not necessarily mean we have accepted your order — risk and title in the goods passes to you only when the item is delivered to you.

3. Delivery

  • Delivery timeframes are estimates only; they are not guaranteed. We shall not be liable for any delay in delivery.
  • Delivery is made by a carrier service that delivers to the address you nominate.
  • If we fail to deliver within 15 days of estimated delivery, we will notify you and you have the option to cancel your order.
  • If there is an error and the delivered product does not match your order, you must notify us within 24 hours of delivery, including invoice/order number and product details. Valid errors will be rectified by us within a reasonable timeframe.

4. Shipping

  • Orders are generally dispatched within 24–48 hours (Monday to Friday) from our warehouse.
  • For standard shipping within Australia, shipping may be free or as indicated. Express shipping may be available at additional cost.

5. Cancellation by Losa eyewear

  • If a product is listed at an incorrect price or with incorrect information at the time of your order, we reserve the right to cancel the sale.
  • If payment has been received, we will refund you in full within a reasonable time.

6. Cancellation by You / Change-of-Mind Returns

  • You may cancel your order or return a product if it is faulty, not as described, or if you change your mind (subject to stipulations below).
  • Change-of-mind returns must be initiated within 14 days of delivery, the item returned in original condition, in its original packaging, with all tags attached and unused.
  • Return shipping costs for change-of-mind are borne by you, unless we agree otherwise.
  • Promotional items or items received free as part of a deal must also be returned in order for a refund to apply on the full purchase.
  • After the stipulated return period, we may at our discretion offer store credit instead of refund.

7. Tax and Duties

  • All Australian orders include GST (10%) where applicable.
  • For international orders, you are responsible for any customs duties, taxes, or local fees in your country of delivery.

8. Warranty

  • Losa Eyewear products are guaranteed against faults or defects in materials and workmanship for 12 months from purchase date (the “Warranty Period”).
  • We may at our sole discretion repair or replace any product that we determine is defective under warranty.
  • This warranty does not cover: general wear and tear, accidental damage, misuse, neglect, modification, or alteration of the product.
  • Any alterations made to the item void the warranty.
  • Except as required by law, all implied warranties (including merchantability or fitness for purpose) are excluded to the extent permitted by law.
  • Our total liability is limited to the purchase price paid by you for the product.

9. Limitation of Liability

  • Neither we nor our suppliers, affiliates, directors, officers, representatives or employees shall be liable for any indirect, incidental, special, consequential or punitive damages, loss of profits or revenue, or interruption of business, arising from any goods or services supplied under this agreement.
  • Our aggregate liability for any claim shall not exceed the total amount paid by you for the product in question.

10. Intellectual Property

  • All intellectual property rights (registered or unregistered) in the website, branding, product designs, content and materials are owned by Losa Eyewear or its licensors.
  • You must not reproduce, modify, distribute or otherwise commercially exploit any part of the website or its materials without our prior written permission.

11. Hyperlinks to Other Sites

  • Our website may contain links to third-party websites. We make no representation and accept no responsibility for the operation, content or nature of any such linked site.

12. Applicable Law

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of Western Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

13. Confidentiality

  • You may be required to provide confidential information (such as your name, address, payment details) when placing an order. We will keep this information confidential and not disclose it without your consent, except as required by law.
  • This clause does not apply to information already in the public domain, or information you already knew, or information which is required to be disclosed by law.

14. Disclaimer

  • All information, products and services provided through the website are provided “as is” without warranty of any kind, to the extent permitted by law.
  • We disclaim all warranties, express or implied, including but not limited to implied warranties of fitness for purpose or merchantability.
  • We will not be liable for any loss or damage you suffer in connection with your use of the website or linked sites.

15. Marketing & SMS Terms

  • By subscribing to marketing updates, you consent to receive promotional messages and alerts from Losa Eyewear at the contact details you provide.
